Public school teachers deserve overtime pay
May karapatan ang mga public school teacher na makakuha ng overtime pay kapag sumobra sa walong oras ang kanilang trabaho sa isang araw.
Ayon kay human rights lawyer Chel Diokno, nakasaad sa Section 13 naman ng Magna Carta for Public School Teachers o Republic Act No. 4670 at DepEd Memorandum No. 291, Series of 2008 na dapat limitado sa walong oras ang trabaho ng mga guro sa pampublikong paaralan.
Ang anim na oras ay maaaring gamitin sa aktuwal na pagtuturo habang ang natitirang dalawang oras ay nakalaan naman sa mga aktibidad at tungkulin na may kinalaman sa pagtuturo.
Kabilang dito ang paghahanda ng lesson plan, pagdalo sa seminar at workshop, counselling, pagsasaliksik, konsultasyon at conference sa mga magulang, at iba pa.
Kung kailangang magbigay ng serbisyo ng higit sa anim na oras na pagtuturo o higit walong oras ng kabuuang trabaho sa isang araw, dapat bayaran ang guro ng overtime pay o additional compensation na naka-compute sa regular hourly rate na may dagdag na 25 porsiyento.
Maaaring mag-claim ng overtime para sa aktuwal na pagtuturo o trabaho na ginawa sa loob ng paaralan.
“Kung kulang ang pondo, sa halip na overtime pay ay dapat bigyan ang nag-overtime na teacher ng service credits na katumas ng 1.25 oras para sa bawat oras ng overtime,” wika ni Atty. Chel.
Dapat may kaukulang dokumento at approval ng school head ang request para sa overtime, dagdag pa ng human rights lawyer.
