Injunction vs UV Express P2P policy sought

After voicing their concerns and seeking a temporary restraining order against the Land Transportation Franchising and Regulatory Board order requiring all UV Express units to strictly adhere to a terminal-to-terminal policy, transport groups are now eyeing a permanent injunction.

The plan comes at the heels of a Quezon City Regional Trial Court decision rendering the prayer for temporary restraining order as moot and academic as the LTFRB order is still suspended.

Last week, the LTFRB indefinitely put on hold the enforcement of Memorandum Circular No. 2019-025 until other transport sectors have been consulted.

“However, because of the temporary nature of the suspension by the LTFRB of the circular, counsel for petitioners insisted that the prayer for preliminary injunction still be heard,” the order released on Monday said.

The court ordered both parties to submit their respective memoranda as to the appropriateness of the issuance of a preliminary injunction within 15 days.

Present at Monday’s hearing were petitioners Stop and Go Transport Coalition and Defend Job Philippines, who labeled the LTFRB order as “oppressive and authoritarian.”

Jun Magno, national president of Stop and Go Transport Coalition, again urged the LTFRB to consider the proposal of a selected stop system of pick-up and drop-off points instead of a point-to-point system for UV Express units.

Under the memorandum issued by the Board in May, all UV Express units were ordered to strictly operate on a terminal-to-terminal basis, prohibiting them to load or unload in between endpoints.
