LTFRB told to issue licenses to ride hailing services

After studying both sides of the issue involving the Land Transportation Franchising and Regulatory Board (LTFRB), and the transport network vehicle services (TNVS) applicants, the Anti-Red Tape Authority (ARTA) on Tuesday ordered the LTFRB to issue the corresponding  Certificates of Public Convenience (CPCs) and other appropriate licenses to TNVS applicants.

Earlier, ARTA had asked the LTFRB to explain the delays in the processing of TNVS units, and the other alleged irregularities that they discovered.

Arta noted that TNVS applicants have filed numerous complaints against LTFRB regarding its issuance of Provisional Authority (PA), and CPCs.

“The aforementioned applications are deemed automatically approved and  by operation of Law.  In view thereof, LTFRB is hereby ordered to issue the corresponding CPCs, or other appropriate licenses or certifications for all these TNVS operations,” ARTA Director General Jeremiah Belgica said during a press conference in Makati City.

In the Order of Automatic approval issued by ARTA, the LTFRB was also directed to furnish the Authority a list of all pending TNVS applications that have submitted the complete documentary requirements, have duly paid required, and have been duly heard from July 7, 2018 until July 24, 2019, but whose CPCs  are yet to be issued. The LTFRB is given three days upon receipt of the order to comply.

The LTFRB told the Authority that it was undermanned, and lacked infrastructure, which were the reasons why the release of the certifications and/licenses were delayed, the ARTA director general told the media.

Belgica also ordered LTFRB to review and revise its Citizen’s Charter, saying it should be reengineered, taking into consideration ARTA’s policy recommendations, and must include the documentary requirements and processing time specific to TNVS applications.

“The revised Citizen’s Charter must likewise indicate which transactions are considered simple, complex, and highly technical in accordance with RA 11032. Such revised Citizen’s Charter  shall be submitted to the Authority within 20 days from receipt of this Order, which shall be subject to the review of the Authoriy,”he added.

The ARTA director general reiterated that government agencies should streamline all services to the public.

“In line with our directive to LTFRB, we are also calling on all govt agencies to submit all their Citizen’s Charter as required by Law,” Belgica said.

He also asked LTFRB to reconsider t no longer include bank certificate of conformity, and proof of garage as requirements to TNVS.

Administrative charges await officials who would fail to follow the law requiring them to streamline current systems and procedures of government services, Belgica warned government officials.

Other alleged irregularities committed by LTFRB were its failure to implement the Memorandum Circular 2018-005, which allowed hatchback cars to operate as TNVS; failure to conduct hearings and render decisions for an unreasonable length of time on the applications of CPC and motions for reconsideration of dismissals; imposition of additional requirements without due cause; imposition of undue regulatory burden and cost; inconsistent, arbitrary and varying interpretations and implementations of the rules and regulations on TNVS applications; and implementing abrupt changes in the requirements and procedures for TNVS application without due notice to the public.
