Courts resume physical operations on June 1
Courts will be in full operation on June 1 at the start of the effectivity of President Rodrigo Duterte’s directive to ease restrictions in many parts of the country.
Chief Justice Diosdado Peralta issued Administrative Circular 41-2020 which orders courts under the National Capital Judicial Region to operate weekdays from 8 a.m. to 4:30 p.m. and from 8 a.m. to 5 p.m. in Regions 1 to 12.
Night courts and Saturday courts shall remain suspended, as well as flag raising and retreat ceremonies, and all official meetings, seminars training and other functions in the Judiciary unless conducted through video conferencing or authorized by the Judiciary Task Force on Covid-19.
Due to limited public transportation, courts and offices of the court may continue to function with a skeletal force, if necessary, upon determination by the chief justice and associated justice and other justices authorized by the high court.
The Supreme Court has also advised courts to proceed with the raffle of cases regularly either electronically in e-Court stations or in accordance with the procedure laid down on the guidelines on the selection and designation of executive judges and defining their powers, prerogatives and duties.
All courts were likewise directed to resolve and decide all the cases pending before them with the hearings, regardless of the stage of the trial, shall be in-court, except in cases involving persons deprived of liberty (inmates) who shall continue to appear remotely from the detention facility, and in cases with extraordinary circumstance as may be determined by the justices and judges, which shall be held through video conferencing.
It further said that there shall no longer be extensions in the filing of petitions, appeals, complaints, motions, pleadings and other court submissions that will fall due beginning
June 1, 2020.
